HC adjourns hearing on NSU trustees' bail plea till Sunday

The High Court adjourned hearing on petitions filed by NSU Trustee Board members seeking anticipatory bail in a graft case till Sunday.

The applicants are MA Kashem, Benajir Ahmed, Rehana Rahman and Mohammed Shajahan.

A division bench of Justice Md Nazrul Islam Talukder and Justice Kazi Md Ejarul Haque Akondo adjourned the matter following a plea by lawyers of petitioners on Thursday.

Meanwhile, the court directed the petitioners to appear in person on Sunday.

Having partially heard on Wednesday, the petitions had to be heard again on Thursday followed by an order.

As the matter came up for hearing on Thursday morning, Barrister Sayed Ahmed, one of the lawyers of the NSU trustees, prayed for adjournment on the ground that they were not ready.

ACC counsel Khurshid Alam Khan vehemently opposed the adjournment saying the accused petitioners committed cognizable offence and do not deserve adjournment.

“It is cognizable offence. My Lord today is fixed for final hearing and order. So, time killing on any pretext should not be allowed,” said ACC lawyer.

Echoing view of ACC lawyer, Deputy Attorney General Aminuddin Manik also opposed adjournment plea. He prayed to the court to pass order instead of adjourning hearing.
But Barrister Sayed told the court that the clients are not feeling the country. He said NSU trustees will submit a supplementary petition having more grounds for their bail.

“Please give us access to justice by allowing adjournment needed to file supplementary petition,” he said.

Hearing both sides, the court decided to hear the matter at 2pm on Sunday and pass order.

On May 5, the Anti-Corruption Commission (ACC) sued NSU trustee board Chairman Azim Uddin Ahmed, members Benajir Ahmed, MA Kashem, Rehana Rahman and Mohammed Shajahan, and Ashaloy Housing and Developers Ltd Managing Director Amin Md Hilaly for embezzling Tk 303.82 crore of the university.

The accused misappropriated the money in the name of purchasing 9,096.88 decimals of land in Rupganj of Narayanganj in connivance with one another.
