Writ against Presidential clemency

DHAKA: A writ was filed with the High Court challenging the power of clemency to any convicts by President as per constitution.   

Allude to the Article No.49 of the constitution empowers President to pardon any convicts.

Advocate Manzill Murshid, on behalf of human rights organization Human Rights and Peace for Bangladesh (HRPB) filed the writ on Sunday noon.

HRPB sought HC rule upon the authorities concerned of the government to explain why article 49 of the constitution should not be declared unconstitutional.

Senior secretary to the President’s office, principal secretary of the prime minister’s office and secretaries to the cabinet, Jatiya Sangsad and legislative and drafting division of the law ministry were respondents to the sought rule.

In the writ, HRPB said that the article is contradictory to the basic structure and fundamental rights guaranteed in the constitution.
