DHAKA: A writ was filed Wednesday with the High Court challenging the legality of an education ministry’s order that mandates Class XI admission for 2015-16 academic session based on the merit-list.
Supreme Court lawyer Yunus Ali Akand filed the writ petition with the HC branch concerned in the morning.
Yunus Ali Akand said that no admission should be based on merit-list; rather it should be performed through test. Government policy, in this regard, is contradictory to several Articles of the Constitutions, he added.
Earlier on June 1, Education Ministry issued a circular that asked the colleges authorities to admit HSC students on the basis of the merit-list of the students who passed the SSC exams in 2015, to be prepared by government.
Later three colleges – Notre Dame College, Holy Cross College and St Joseph College in Dhaka – filed writ petitions challenging the legality of six sections—3.1, 4.1, 4.2, 5.3, 9.1, and 9.3--of the circular.
Responding to the petition, the HC on Monday stayed the government decision for next six months for these three colleges.
The HC subsequently issued a rule upon the government seeking explanation in next four weeks why the six sections of the circular on admission process should not be declared illegal.
