No bar to release Fakhrul on bail

DHAKA: The Supreme Court upheld the High Court order that granted bail to BNP acting secretary general Mirza Fakhrul Islam in three cases.

A 4-member Appellate Division bench led by Chief Justice SK Sinha passed the order on Monday morning.

There is no legal bar for his client's release from jail following the verdict as bail order in three other cases was upheld by the apex court, says Fakhruls’ lawyers.

Paltan Thana police filed the cases on January 4 and 6 against the BNP leader for creating sabotage in Paltan area during BNP-led 20-party alliance called nationwide hartal.

On January 6, police arrested Fakhrul from the premises of National Press Club in city.

Later on June 21, High Court bench of Justice Mohammad Reza-ul Haque and Justice Mohammad Khasruzzaman granted Fakhrul’s bail in three violence cases.

On June 29, the government filed a petition seeking stay on the High Court order that granted bail to Mirza Fakhrul in three cases.

On July 9, authorities of Bangabandhu Sheikh Mujib Medical University (BSMMU) submitted medical report of Mirza Fakhrul on his physical condition as per court order.

On the same day, the Supreme Court ordered BSMMU to form a new medical board for the BNP leader asking to submit medical report before the court on July 12.

The apex court also fixed July 13 for pronouncing verdict on government petitions seeking stay on the High Court order that granted bail to Fakhrul in three cases.

Attorney General Mahbuey Alam moved for Fakhrul while Supreme Court Lawyers Association president Advocate Khandaker Mahbub Hossain stood for Mirza Fakhrul.
