DHAKA: The investigation agency of the International Crimes Tribunal (ICT) finalized the probe report seeking ban of Jamaat-e-Islami for their involvement in crimes against humanity during liberation war in 1971.
The 337-page report is likely to be submitted to the ICT on Thursday or next week.
In the final report prepared in the light of International Crimes (Tribunals) of 1973, investigators sought ban of Jamaat and all its front organizations in Bangladesh.
On Tuesday morning, the tribunal investigation agency informed in a briefing that a report containing 373-page has been prepared against Jamaat-e-Islami as a whole for opposing the liberation war using arms.
Charges were brought against all the crimes committed during the great liberation war from March 25 to December 16 in 1971, Jamaat and its front organizations Islami Chattra Sangha, Peace Committees, Razakars, Al-Bdars and Al-Shams and their media daily Sangram.
In August of last year the Investigation Officer (IO) Matiur Rahman after investigation for seven months has prepared this report.
In a press briefing held at the Dhanmondi office of the Investigating agency informed that seven charges of genocide, war crimes, violation of Geneva Convention and International law and attempting to commit war crimes and conspiracy and their failures to check those crimes were brought.
In report it was told that Jamaat and its front organizations have committed crimes as per 1, 2 of section 4 of International Crimes (Tribunals). The activists of all these organizations were made offenders of those crimes.
The chief coordinator of the Investigation Agency Abdul Hannan Khan informed that it has been recommended to ban Jamaat and its front organizations so that no person or organizations can commit such type of crimes in future.
Senior member of the agency Sanaul Haque, IO Matiur Rahman and Prosecutor Turin Afroz were present in the briefing.
In the briefing, it was informed that the main report contains 373 pages attached with 2303 page seized documents in seven volumes, documentary evidences, other documents of 3761 pages in 10 volumes, earlier judgments of ICT and observations against Jamaat, over 200 books, magazines and research papers will be submitted.
Seventy people will be prosecutions witness against Jamaat.
The Investigation Agency informed that all the past and present activities have included in the final report.
The report also contains Jamaat’s financial organization Falah Aam Trust, Shatabdi press of Islami Chattra Shibir (ICS), Islamic Economic Bureau, Bangladesh Islamic Center, Bangla Shahittya Parishad, Biporit Uchcharan, Saimum Shilpi Gosthi, Fulkuri, Islamic Institute, Jamaat’s publishing house Adhunik Prakashani Press, Islamic Education society, Darul Islam Trust, Sonar Bangla patrika, Ibne Sina trust, Rabeta-e-Islam, Islami Bank and many other organizations, including Islami Samaj Kalian Parishad.
The agency has collected evidences against Jamaat both from within and outside the country. They have also prepared both documentary and verbatim evidences.
The agency has prepared the report since their attack on the Ahmodia sect in 1951 and also their activities after the liberation war. Importance has been given on the ideology and philosophy of their founder Abul Ala Moududi. Books written by Moududi were used as references in the report.
The investigators informed that to prove the crimes the news stories of daily Sangram is enough still the stories published during liberation war in the daily Ittefaq, Purbadesh, Dainik Pakistan, Daily Azad, Daily Paigam and Daily Pakistan Observer were used for collecting information.
Besides, there are evidences of war crimes against Jamaat are visible in the Police Intelligence reports of Home Ministry prepared in 1971.
It has been told in the report that though Jamaat committed crimes like genocide, killings, rape, arson, lootings but they never admit their mistakes.
Rather their acting Amir Abbas Ali Khan December 7 of 1980 and on March 29 of 1981 in press conferences categorically had said that the role of Jamaat in 1971 was right and added that in 1971 the Bangladesh concept was not correct.
At that time Pakistani citizen (later on Ameer of Bangladesh Jamaat) similarly said that, ‘Bangladesh is the name soil not of ideology).
It may be mentioned here that so far ICT-1 and ICT-2 awarded capital punishments to Jamaat leaders Abul Kalam Azad alias Bachchu Razakar, Abdul Kader Molla, M Quamruzzaman, Ali Ahsan Mujahid. Of them only Kader Molla’s verdict was executed and ninety years imprisonment to Golam Azam.
In the observations made in all the ICT judgments it has been mentioned that Jamaat is a criminal organization.
In the press briefing, it was informed that there is no legal barrier in adjudicating Jamaat for banning in Bangladesh.
