The High Court had given a stay order on the temporary sacrificial cattle market in Aftabnagar of the capital.
The Appellate Division of the Supreme Court stayed the verdict of the High Court. As a result, there is no bar to set up a cattle market there.
Following the High Court order, an appeal bench comprising three Justices headed by Justice Obaidul Hasan stayed the order for four weeks on the petition of Dhaka North City Corporation. Thus, cattle market is being set up in the designated place of Aftabnagar in Dhaka, said lawyers.
In the hearing, lawyer Sayeed Ahmed Raza stood on behalf of the city corporation while lawyer Md Yunus Ali Akand appeared for the writ petition.
Talking to a journalist, lawyer Sayeed Ahmed Raza said the Appellate Division stayed four weeks the High Court order that postponed the lease notification of the temporary cattle market in Aftabnagar. Therefore, the city corporation can set up a temporary cattle market in Aftabnagar finalising the lease through tender invitation as per the circular.
On May 15, the writ petition was filed with the High Court seeking direction not to set up a cattle market in the area on the occasion of Eid-ul-Azha. Lawyer Md Yunus Ali Akand filed the writ petition in public interest demanding environmental protection.
In the writ, the secretary of Ministry of Local Government, Rural Development and Co-operatives, Dhaka North City Corporation, chief land officer of Dhaka North City, chairman of Rajdhani Unnayan Kartipakkha (RAJUK), Eastern Housing and Dhaka district commissioners were made defendants.
