The High Court (HC) today (July 30) exempted two police officials from personal appearance after they sought unconditional apology for arresting a college student having anticipatory bail.
A High Court division bench of Justice Mustafa Zaman Islam and Justice Md Aminul Islam passed the order and adjourned the matter for two weeks.
The two accused police officials are: acting officer in-charge (OC) of Patuakhali Sadar Police Station Md Moniruzzaman and assistant sub-inspector (ASI) Mizanur Rahman.
The High Court on May 21 issued a suo moto rule after Supreme Court lawyer Ali Ahsan Mollah brought the matter to the court's attention. The court summoned the two accused cops on June 18 to submit their explanation.
The two cops appeared on that day and sought unconditional apology in writing on July 24. The court on that day had fixed today for passing order.
Advocate Ali Ahsan Mollah moved the case for the college student, Md Ashraful Hawlader, while Advocate Abu Reza Md Qaium Khan stood for the two police officials. Deputy Attorney General Md Sarwar Hossain took part in the hearing for the state.
College student Ashraful was arrested from his home in a case on May 18. He was granted anticipatory bail in the case by the High Court. Though the police was informed of the matter, yet they arrested and produced him before court the next day.
Patuakhali Chief Judicial Magistrate Court, however, let him go after seeing the bail order from the High Court.
