DHAKA: The appellate division of the Supreme Court did not give any decision on petition challenging the High Court order, declaring illegal the Ashiyan City’s residential project in the capital’s Dakkhin Khan.
An appellate division bench comprising four justices led by Senior Justice Surendra Kumar Sinha (SK Sinha) remained silent in giving any order on Monday.
So, the HC order remained upheld on the matter.
Barrister Rafiqul Haque, Rokon Uddin Mahmud and Ajmalul Hossain QC for Ashiyan city and former attorney general Mahmudul Islam for writ petitioner moved the case.
Earlier on January 16, based on the opinion of majority, an HC bench comprising Justice AB Mahmudul Haque, Justice Kazi Reza-Ul Haque and Justice ABM Altaf Hossain passed an order declaring the Ashiyan City’s residential project illegal.
On December 22, 2012, several humanitarian and environmental organizations filed a writ petition with the HC challenging the approval to Ashiyan City’s Dakkhin Khan Project by RAJUK and environmental department.
On January 2, 2013 an HC bench of Justice Mirza Hossain Haider and Justice Muhammad Khurshid Alam ordered to postpone selling, and filling the holes in plots and advertising of it including suspending the approval letter by RAJUK and environmental department.
