DHAKA: The Appellate Division Monday upheld the High Court order that granted three-month bail to BNP acting secretary general Mirza Fakhrul Islam Alamgir in the sabotage cases.
The four-member bench led-by Chief Justice SK Sinha passed the order on Monday.
After the order, there is no bar to release of Fakhrul from jail, said his lawyers.
On November 24, the High Court granted Mirza Fakhrul three-month bail in three cases of vandalism and arson.
Later on November 26, chamber judge sent the appeal filed by state, seeking stay of the HC order, sent to the full bench of the appellate division for hearing.
Additional attorney general M Momtaj Uddin Fakir moved for the state while lawyer Joynul Uddin stood for Fakhrul.
On November 3, Mirza Fakhrul surrendered to the CMM court and appealed for bail.
But a city court has sent BNP acting general secretary Mirza Fakhrul Islam Alamgir to jail in three violence cases.
Earlier on November 2, a 4-member appeal bench, led by Chief Justice SK Sinha rejected the BNP leader’s appeal for extending the date of his surrender.
