DHAKA: The Appellate Division of Supreme Court delivered a verdict on Sunday (May 21) directing that the 140 physicians of Bangabandhu Sheikh Mujib Medical University (BSMMU) recruited in the then BNP-led 4-party government will remain employed in the institution.
A five-member appellate bench led by Chief justice Surendra Kumar Sinha passed the order after hearing in five appeal pleas in this regard.
Since December 2005 to January 2016, some hundreds of physicians were recruited to the institution following a vacancy notice by BSMMU authority published on October 18, 2005.
Later, Swadhinata Chikitsak Parishad (Swachip) President Iqbal Arslan filed a writ with the High Court alleging that the recruitment process was a violation of law.
On January 2, 2006, the High Court issued a rule staying the recruitment process and the notice.
After final hearing upon the rule, the HC delivered a verdict declaring the recruitment illegal, on December 14, 2010,
Later, some physicians including one Khairun Nahar filed a leave to appeal challenging the HC order.
On February 22, the appellate division upheld the HC order rejecting the appeal pleas.
Later, the apex court allowed the physicians to file appeal for reviewing the HC verdict. Following the permission, five appeals were filed by a total of 140 physicians in this regard.
On Sunday, senior lawyer Dr Kamal Hossain, Amir Ul Islam and Kamrul Haque Siddiqui moved for the physicians whereas senior lawyer Mahbubey Alam and Barrister Tanjib-Ul-Alam moved for the BSMMU authority at the court.
