DHAKA: The alleged owner of the private car who filed a writ plea against the officer-in-charge (OC) of Bhatra police station was screwed and fined by the High Court.
The court on Thursday (August 24) fined the businessman of city’s Kuril area Md Momin Uddin Tk. 50,000, as he is not the genuine owner of the private car, which seized by the police.
The HC bench of Justice Kazi Rezaul Haque and Justice Mohammad Ullah also exempted OC Kamruzzman from the charge.
Earlier on Wednesday (August 23), the HC bench summoned the OC, as he was accused by the businessman on charge of not returning the car even after a month of its seizure.
The HC asked the OC to appear before the HC bench along with the seized car on Thursday (August 24). It also issued a rule asking the authorities why the seizure of the businessman’s car won’t be illegal.
Inspector general of police (IGP), deputy commissioner of Dhaka, SP and OC of the Bhatara police station were made respondents to the rule.
The businessman filed the writ petition with High Court alleging that ‘his car’ was seized by the Bhatara police from Bhatara area on July 13. Later, he ‘provided document of his ownership and other documents in this regard. But the OC did not return his car’.
The HC fined the businessman because another person is the owner of the car. Momin Uddin could not submit any document in favor of his claim before the High Court.
The HC bench in its order also said that the original owner of the car can file an application to the judicial court to bring back his vehicle.
Deputy attorney general Tapos Kumar Biswas moved for the state, while Barrister Belayet Hossain moved for the businessman in the court.
Tapos Kumar Biswas said that the police sent a letter to the BRTA to know the genuine owner of the car. The BRTA informed the police that the owner of the car is one Mahzabin Chowdhury.
However, the alleged owner Momin Uddin is accused in at least three cases filed with city’s Bhatara and Comilla’s Daudkandi police stations.
