DHAKA: The Appellate Division of the Supreme Court fixed October 15 for rehearing an appeal in a case filed over killing Khalaf Ali, a Saudi Arabia Embassy official in Dhaka.
The Appellate division led by Acting Chief Justice Md Abdul Wahhab Miah passed the order Tuesday (October 10), for hearing from a death-row convict in the case.
The SC was earlier set to announce the verdict against a High Court order in the case Tuesday.
“The verdict won’t be delivered today. It will be announced on Sunday (October 15)”, said the court.
“Earlier, no lawyers were set to move for death-row convict Saiful at the court. Now, a decision has been made to assign a lawyer on his side”, said Mahmuda Begum, advocate on record.
Khalaf Al Ali, 45, the embassy official, was shot before a house holding no#19/B, Road#120, in the diplomatic area of Gulshan, at around 01:00am March 6, 2012.
He died at the hospital several hours later.
Law enforcers detained Saiful Islam Mamun, Akbar Ali Lalu alias Rony and Al Amin from the Gaowair area of Dhaka’s Dakshinkhan on June 4 the same year.
Afterwards, Saiful, Al Amin, Akbar and one Rafiqul Islam Khokon were shown arrested in the case filed over the murder.
On October 31, Dhaka-4 Speedy Trial Tribunal Judge Md Motahar Hossain indicted the four including one Selim Chowdhury alias Selim Ahmed in the case.
The tribunal ordered death penalties to the five accused, in December the same year.
Of them, Selim had been absconding.
Later, the High Court upheld the death sentence for Saiful given by the tribunal.
Besides, death-penalties were commuted to life-terms for Al Amin, Akbar and Rafiqul while Selim was acquitted, by the High Court.
Afterwards, the state filed a leave to appeal against the HC verdict which was later granted by the Appellate Division on July 23, 2014.
Hearing on the appeal began on August 9 this year.
The state assigned lawyer Helal Uddin Mollah to present arguments at Appellate Division bench-2 led by Acting Chief Justice Md Abdul Wahhab Miah, on August 20.
Attorney General Mahbubey Alam and Deputy Attorney General Biswajit Debnath moved for the state at the courtroom.
