DHAKA: The High Court asked four people including the UNO and OC of Chittagong’s Lohagora upazila to appear before it on January 28 for penalizing a man through mobile court who was already in police custody.
The High Court bench of Justice Mohammad Dastagir Hossain and Justice Ataur Rahman Khan passed the order on Sunday (January 14) following a writ petition filed by the convict.
The four who were summoned are- Upazila Nirbahi Officer (UNO) Mahbub Alam, Officer-in-charge (OC) Md Shahjahan, Sub-inspector (SI) Helal Khan and Wasim.
The convict Belaluddin, who was sentenced to 8 months imprisonment by the mobile court for possessing two packs of hemp, filed the writ petition challenging the mobile court verdict.
Advocate Manzil Morshed moved for the petition in court.
He said police detained Belaluddin in a separate case on October 13 in 2017 and sent him court on the next day. However, According to Oct 14 mobile court verdict, it was shown in statement that Belal was detained on that day from his village home with two packs of hemp in possession. It proves that he has been penalized by the mobile court while he was in custody which is against the law and constitution.
The High court also issued a rule asking authorities concerned to explain why the mobile court verdict will not be declared illegal and Belaluddin will not be compensated with Tk 20,00,000.
