DHAKA: The High Court issued prohibitions on requisitions of private cars, CNG auto-rickshaw and taxis by police.

The HC bench of Justice Naima Haider and Justice Khizir Ahmed Choudhury passed the judgment on Wednesday (July 31).

Manzil Morshed moved for the writ while Mushtaq Hossain stood for the Dhaka Metropolitan Police (DMP).

Later, Manzil Morshed said that the HC gave several points of directives rejecting the rule issued in this regard. 

They are: 

1. Requisitions only be carried out in public interest, otherwise action have to be taken against the concerned police official.

2. No police official can use the requisitioned vehicle for his personal or family purpose.

3. Private cars, CNG auto-rickshaws and taxis cannot be requisitioned.

4. Every police station has to maintain a list of requisitioned vehicles.

5. Police commissioner will dispose of and take action regarding complaints against any requisition.

6. The owner of the requisitioned vehicle has to be compensated. Police has to bear the cost of fuel of the requisitioned vehicle and food cost of the driver.

7. One vehicle cannot be requisitioned twice a year.

8. A vehicle carrying women, children and patients cannot be requisitioned.

9. Police commissioner will issue a circular in this regard and ensure observance of those directives.

He added that the court kept the case running.
 
Rights organization Human Rights and Peace for Bangladesh (HRPB) filed the writ petition in the public interest challenging the requisition by police under the provisions of section 103 (a) of the Dhaka Metropolitan Police Ordinance.

After hearing the writ petition, the HC issued a rule on May 25 of that year.
